Terms of Service
Effective date: 18 October 2026
1. The agreement
These terms form a binding agreement between you and Gesana AB, organisation number 559574-4151, of Trollebergsvägen 81B, 22731 Lund, Sweden ("Gesana", "we", "us"). They apply to your use of our products and this website. By creating an account or using a product you accept them. If you do not accept them, do not use the service.
Where you use our products on behalf of an organisation, you confirm you are authorised to bind that organisation, and "you" refers to it.
The minimum age to hold an account is 16. If you are under 16, do not create an account — a parent or guardian may use a product on your behalf under their own account and supervision.
2. The services
Gesana is a software studio. We design and build mobile applications, web platforms, custom software and integrations, and the cloud infrastructure underneath them. We publish products of our own under these terms, and we build software for clients under a separate written agreement.
These terms apply to our own products. Work we do for a client is governed by that engagement's agreement, which takes precedence over these terms for that work. Where we build software for a client, we act on their instructions and their confidential information remains theirs.
3. Accounts
You need an account to use our products. You agree to:
- provide accurate registration information and keep it up to date;
- keep your password confidential;
- be at least 16 years old; and
- tell us promptly at support@gesana.net if you suspect someone else has access to your account.
We may suspend an account where we have reasonable grounds to believe it is being used for fraud, abuse, or to break these terms or the law. Where we can do so without compromising security or the investigation, we will tell you first and give you a chance to resolve it.
4. Your content
You keep ownership of everything you create inside our products — notes, highlights, bookmarks, reading progress, playlists, and the like. We claim no ownership of it.
You grant us a limited licence to host, back up, transmit, and display your content for the purpose of running the service to you. That licence ends when you delete the content or close your account, except for copies that remain in backups until those backups are cycled out.
You confirm you have the rights to put your content into the service, and you are responsible for it. We do not review or pre-screen your content, and we remove content where we have a lawful reason to do so — for example where it infringes someone's rights or where required by law.
Where a product shares content publicly with other users, that is a deliberate choice you make, and you should share only what you are comfortable others seeing.
5. Subscriptions and payment
Where a product offers a paid subscription, the price, billing period and what is included are shown to you before you subscribe. Unless we say otherwise at the point of sale, subscriptions renew automatically at the same price for the same period until cancelled.
Cancelling. You can cancel at any time, and you keep access until the end of the period you have already paid for. Capping means we do not have to refund the remainder of a period you have already used.
Refunds. Where you bought through the Apple App Store or Google Play, those platforms control refunds — contact them. Where you bought through us, we will refund a renewal we have failed to deliver, and we will refund where consumer law gives you the right to cancel or receive a remedy.
Price changes. We will give you at least 30 days' notice before changing the price of a subscription, and the change takes effect from your next renewal after that notice.
6. Acceptable use
You agree not to use our products to:
- break the law, or the rights of anyone else;
- harass, abuse, threaten or impersonate another person;
- make unsolicited commercial contact, or send bulk or automated messages without a lawful basis;
- send malware, or interfere with the security or operation of the service;
- reverse engineer, decompile, or attempt to extract source code from any product, except where that restriction is prohibited by law;
- use our products to build a directly competing product, or resell, sublicense or provide the service to third parties without our written consent; or
- circumvent usage limits, or attempt to access areas you have not been given access to.
Where you break these terms, we may remove content, limit or suspend access, or terminate the account. We take the least severe action that addresses the problem, and we will explain our decision on request.
7. Intellectual property
Our products, their names, their design, and the underlying software are owned by Gesana AB or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to use them for your own purposes in line with these terms. No other rights are granted.
Some products include content licensed from third parties. That content belongs to its owners and your use of it is governed by the applicable licence, which may be more restrictive than these terms.
Feedback you send us may be used by us without restriction or obligation to you, but we will never use your confidential information as feedback.
8. Third-party services
Our products may link to or integrate with third-party services, including Apple and Google. You are responsible for how you use them and for complying with the law that applies to you — including any rules on recording, marketing and consent for calls you place.
We do not endorse, and are not responsible for, third-party content or conduct.
9. Availability and changes
We work to keep our products available, but we do not guarantee uninterrupted access. Planned maintenance is announced in advance where practical, and emergency maintenance may happen without notice.
We may modify, suspend or discontinue features. If we discontinue a feature you have paid for, or an entire product, we will give you at least 30 days' notice and a pro-rata refund of anything you have paid for the part you can no longer use.
If we retire an entire product we will give reasonable notice and let you export your content beforehand.
10. Disclaimers and liability
Our products are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for infringement of your statutory consumer rights, or for anything else that cannot lawfully be excluded. Nothing here limits your right to bring proceedings in the courts of your country of residence.
Subject to that, our total aggregate liability arising out of or in connection with a product is limited to the greater of the amount you paid us for that product in the twelve months before the event giving rise to the claim, or SEK 5,000.
11. Termination
You may stop using our products and close your account at any time — see how to delete your account. Closing the account ends your access and, per these terms, cancels any active subscription.
We may suspend or terminate your account if you materially break these terms, and will give you notice and a chance to fix the problem first where that is appropriate.
On termination you lose access to the service. Your content becomes subject to the deletion process in the privacy policy, and we will not delete your data any faster than that policy allows.
12. Personal data
Our privacy policy explains what personal data we collect, why, how long we keep it, who we share it with, and how you exercise your rights. It forms part of these terms.
13. Governing law and disputes
These terms are governed by Swedish law. Nothing here removes your right to bring proceedings in the courts of your country of residence, nor any right to use mandatory consumer dispute resolution available to you.
Before going to court, please raise the problem with us at support@gesana.net. Most issues are resolved quickly and without either side needing to incur cost.
If we cannot resolve it, you may use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, or refer the matter to the Swedish Consumer Agency (Konsumentverket). We will take part in good faith in any process you reasonably choose.
14. Changes to these terms
We may update these terms — for example when we launch a product or when the law changes. The current version is always at gesana.net/terms.html, and the effective date at the top shows when it last changed.
Where a change materially affects you, we will tell you before it takes effect. If you do not accept a material change, you may close your account and we will refund any unused, paid-for period.
